Criminal Law § 3-203

Second-degree assault

Ordinarily a misdemeanor carrying up to 10 years’ imprisonment, a $2,500 fine, or both. A specified assault on a first responder or officer may be a felony with a different fine. The exact subsection matters.

Record outlook: A dismissal or acquittal may create an expungement question; conviction eligibility depends on the precise offense, sentence, time, and other charges.

Criminal Law § 5-601

CDS possession

For ordinary possession outside special cannabis provisions, a first conviction can carry up to 1 year and a $5,000 fine, or both. Later convictions have different maximums. Cannabis and prescription circumstances have separate rules.

Record outlook: Some dispositions may qualify for expungement, but the substance, disposition, prior record, and other charges affect eligibility.

Transportation § 21-902(a)

DUI

A first offense under subsection (a)(1) can carry up to 1 year and a $1,200 fine, or both. Penalties differ for repeat offenses, other subsections, and transporting a minor. Separate driver’s license consequences may apply.

Record outlook: Do not assume a DUI disposition can be expunged. Ask counsel to examine the exact charge, disposition, and current rules.
